1. General Provisions

- Scope: These terms apply to all sales contracts concluded through the website between the Seller and the Client (Consumer or Business).
- Technical Requirements: To use the store, the user needs a device with internet access, a standard web browser, and an active email address.
2. Ordering Process
- Contract Formation: An order placed by the customer constitutes an offer to purchase. The contract is officially concluded when the store sends an email confirmation of the order acceptance.

- Electronic payments (BLIK, PayU, or Przelewy24).

- Traditional bank transfer.
- Cash on delivery (depending on the courier service).
- Deadlines: If a customer chooses pre-payment (transfer/card), they are usually required to pay within 7 days, or the order may be cancelled.
- Delivery: Orders are shipped via courier (e.g., DPD, InPost) or to Parcel Lockers (Paczkomaty). Delivery times are estimated during checkout (usually 1–5 business days).
4. Right to Withdraw (Returns)
- 14-Day Window: Consumers have the right to withdraw from the contract within 14 days of receiving the product without providing a reason.
- Hygiene Exception (Crucial): Under Article 38 of the Consumer Rights Act, the right to return is excluded for goods delivered in sealed packaging that cannot be returned for health or hygiene reasons if the packaging was opened after delivery (e.g., hair lotions, shampoos, or dermocosmetics).
- Return Costs: The consumer is responsible for the direct cost of returning the goods.
5. Complaints (Reklamacje)
- Warranty: The seller is liable for physical or legal defects (rękojmia).
- Procedure: If a product is defective, the customer can request a repair, replacement, price reduction, or refund.
- Timeline: The store must respond to a consumer's complaint within 14 days.
6. Privacy and Data Protection (RODO)
- Data Controller: The owner of DermaWłosy acts as the controller of personal data.
- Purpose: Data is processed solely for order fulfillment, accounting, and (if consented to) marketing (newsletter).
- Rights: Users have the right to access, rectify, delete, or limit the processing of their data.
7. Final Provisions
- Disputes: Any disputes are first encouraged to be settled through mediation or the ODR platform (Online Dispute Resolution).
- Governing Law: The terms are governed by the laws of Poland, specifically the Civil Code and the Act on Consumer Rights.
